1. Terms of Service

1.1 Introduction

NightingaleRX is an e commerce wellness platform operated by Nightingale Eldercare, LLC under the DBA “NightingaleRX.” The platform sells wellness products, pre visit purchases, and access to telehealth scheduling. NightingaleRX does not provide medical care, medical advice, or pharmacy services.

By using the NightingaleRX website, you agree to these Terms of Service.

1.2 Platform Role

NightingaleRX:

• Is a commercial platform, not a healthcare provider
• Does not diagnose, treat, or prescribe
• Does not compound or dispense medications
• Facilitates access to telehealth services provided exclusively by Nightingale Healthcare

All medical services occur outside NightingaleRX.

1.3 No Provider–Patient Relationship

Use of NightingaleRX does not create a provider–patient relationship.
A provider–patient relationship is established only after you transition to Nightingale Healthcare and are seen by a licensed clinician.

1.4 Purchases

Purchases made on NightingaleRX may include:

• Access to telehealth scheduling
• Wellness products
• Pre visit purchases
• Fees associated with clinical intake processing

Purchases do not guarantee medical approval, prescriptions, or treatment.

1.5 Refund & Return Policy

All sales are final.

Because products may be prescription related or custom prepared, and because Florida law prohibits the return of dispensed medications:

• No refunds (note: If your clinician determines that the medication is not appropriate for your medical condition, a prescription for that medication will not be issued, and you will be given a refund).
• No returns
• No exchanges

This complies with:

• Florida Statute § 501.142
• Florida Pharmacy Practice Act (Chapter 465)

1.6 Shipping Policy

Partner pharmacies ship medications directly. NightingaleRX does not ship medications.
Shipping delays caused by carriers, weather, or incorrect information are not the responsibility of NightingaleRX.

1.7 Pharmacy Independence

Partner pharmacies operate independently and make their own professional decisions regarding dispensing, availability, and shipping. NightingaleRX does not control pharmacy operations.

1.8 Pricing & Availability

Product availability, pricing, and descriptions may change without notice.
NightingaleRX is not responsible for typographical errors or discontinued items.

1.9 User Responsibilities

By using the platform, you agree that:

• You are at least 18 years old
• You will provide accurate and complete information
• You are responsible for complying with your local laws
• You will not misuse or attempt to interfere with the platform

1.10 Limitation of Liability

NightingaleRX is provided “as is” without warranties of any kind.
To the fullest extent permitted by law, NightingaleRX is not liable for indirect, incidental, or consequential damages arising from use of the platform.

1.11 Not Insurance

NightingaleRX is not insurance and does not replace health insurance coverage.

1.12 Governing Law

These terms are governed by the laws of the State of Florida.

2. Privacy Policy (Non HIPAA)

NightingaleRX collects non medical website data such as:

• Email
• Contact information
• Payment information
• Website analytics

NightingaleRX does not collect or store medical information or Protected Health Information (PHI).

All PHI is collected only after the user transitions to Nightingale Healthcare, where HIPAA applies.

3. Checkout Disclosure

“All sales are final. No refunds or returns. NightingaleRX does not provide medical care. You will be redirected to Nightingale Healthcare for telemedicine services.”

4. Transition Notice

“You are now leaving NightingaleRX and entering Nightingale Healthcare, where all medical services are provided by independent licensed clinicians. By continuing, you agree to the Nightingale Healthcare Telehealth Consent and HIPAA Notice of Privacy Practices.”
